Climate Week Awards – Terms and Conditions of Entry to Awards

1. Promoter details

1.1 The promoter of the Climate Week Awards (the “Awards“) is Climate Week Ltd (the “Promoter“), a company registered in England and Wales with registered number 06646940 whose registered office is at 35 Ballards Lane, London, N3 1XW.

2. Conditions of entry

2.1 The Awards are open to any individual, school, company, organisation, campaign or event which is based in the UK. Employees of the Promoter, as well as their relatives or members of their family or households are not allowed to be nominated for the Awards, and any nomination for any such person or entity may be deemed invalid by the Promoter. Artistic works must have been exhibited or performed in the UK.

2.2 Please check the Award categories for the most relevant Award for your nomination(s).

2.3 Please note that only UK residents are entitled to submit nominations and, in respect of nominating individuals, where practicable, please seek their permission before nominating and draw these Terms and Conditions to their attention.

2.4 If you are under the age of 12 you must obtain permission from your parent or guardian before making a nomination.

2.5 By submitting a nomination, you are deemed to accept and be bound by these Terms and Conditions. Please read them carefully and please contact us if you have any queries.

3. How to nominate

3.1 Full details on how to nominate can be found at www.climateweek.com.

3.2 The deadline for nominations is 17:00 hours on 30 January 2012.

3.3 Activities forming the basis for any nominations must have taken place between 30 January 2010 and 30 January 2012.

3.4 Each nomination must be in the form of a written submission of no more than 700 words. Nominations that exceed this will NOT be considered. Up to three images can be provided to illustrate the nomination. The size of the email and any attachments must not exceed a combined total of 1 MB. Shortlisted candidates will be asked for more detailed information at a later stage.

3.5 Nominations must be submitted to awards@climateweek.com. Following submission of your nomination(s), you will receive on screen confirmation that you have made a nomination for the Awards.

3.6 Nominations may be submitted in any of the listed categories (“Categories“). A complete list of Categories can be found at www.climateweek.com. You may submit nominations in as many Categories as you feel appropriate. But please note that only one nomination per person will be accepted in each Category.

3.7 You can nominate yourself or a third party for any Category providing, where practicable, permission has been given.

4. Winners and prizes

4.1 The themes, judging criteria and Awards process are set out in the Awards entry pack. This can be found at www.climateweek.com.

4.2 The winner in each Category will be determined by the following criteria:

4.2.1 Inspiration: Can the entry inspire others to look at their own behaviour or actions and consider changing them?

4.2.2 Innovation: Has the entry applied fresh thinking to problems or developed new solutions?

4.2.3 Impact: How has the entry made a real difference in helping to tackle climate change?

4.3 The Promoter will select shortlisted entries for each Category. This shortlist will be judged by a panel of judges. The shortlisted entries will be notified by 27 February 2012.

4.4 The decision of the judges is final in choosing the winners of the Awards and the decision of the Promoter will be final in all other regards. No correspondence will be entered into in respect of this decision.

4.5 There is one winner only per Category. Winners will be notified at the presentation ceremony on 12 March 2012.

4.6 All shortlisted entries will be invited to an award ceremony to be held at a central London location. Winners shall be responsible for all costs of attending including travel to and from the award ceremony, food and drink, personal expenditure or incidental costs, other than where stated.

4.7 The Promoter shall grant to each winner a non-exclusive, limited, non-transferable, non sub-licensable, revocable licence to refer to its position as a winner in its UK-based marketing material, provided each such reference includes the full title and year of the award. The Promoter may revoke this licence in its reasonable discretion.

4.8 In the event the Promoter is unable to contact the winners by 18 March 2011, or a winner is unwilling or unable to accept its Award, the Promoter reserves the right to award the prize to another entrant who, in the opinion of the judges and in accordance with these Terms and Conditions, is the next best entry.

5. Use of your data

5.1 By disclosing personal information to us, you agree that we may obtain, hold and use any personal information you submit to us for the purposes of processing your nomination and administering these Awards and if you indicate your acceptance during the nomination process (for example, by appropriately marking the relevant box(es) provided) for marketing our other products and services to you.

5.2 Any personal information relating to each nomination will be used by the Promoter solely in accordance with current data protection legislation. Please also see our Privacy Policy at www.climateweek.com (the “Website“).

6. User submissions

6.1 Any communications and/or other material which we receive from you (including without limitation by email and any material that you submit via this Website) (“User Material”) will be deemed non-confidential and non-proprietary and we reserve the right to use User Material on this Website, any other website operated by us and in our offline publications where we consider this appropriate. You hereby grant to us a perpetual, irrevocable, worldwide, royalty-free, non-exclusive, sub-licensable right and licence to use, reproduce, modify, adapt, edit, and publish such User Material on this Website, any other website operated by us and in our offline publications and for all other commercial and non-commercial purposes related to our work. If you do not wish to grant such rights to Climate Week, then please do not submit any User Material to us.

6.2 By submitting any User Material, you:

(a) warrant that such User Material is your own original work and that you are fully entitled to make it available to us for all the purposes specified above; and
(b) agree to waive any moral rights in your User Material.

6.3 Under no circumstances should you submit any User Material:

(a) that is knowingly false or misleading;
(b) that is defamatory, illegal, abusive, vulgar, obscene, inflammatory, of a racist, sexist or other discriminatory nature, in breach of confidence or privacy or which is otherwise unlawful or offensive, or which might reasonably cause offence to any person or damage the reputation of Climate Week. You must not use any abusive or aggressive language, swear, threaten, harass or abuse any other person, including other users;
(c) which you do not own or for which you have not obtained all necessary licences or approvals;
(d) which is technically harmful including, without limitation, computer viruses, Trojan horses, worms, corrupted data, malicious software or harmful data;
(e) impersonating any person or entity or falsely stating or otherwise misrepresenting your affiliation with any person or entity.

6.4 Any User Material submitted to us is submitted on the basis that we may review and edit such User Material prior to publication. We reserve the right to remove any User Material or part thereof published on the Website at any time and for any reason at our absolute discretion without notification to you, including for the avoidance of doubt if the Promoter determines, or is informed, that the User Material or the circumstances of their production are unsuitable for any reason.

6.5 You agree to indemnify, defend and hold harmless Climate Week and its directors, officers and employees, from and against all liabilities, claims, demands, expenses and costs arising out of your submission of User Material which breach these Terms.

6.6 Please note that User Material supplied by you will not be returned.

7. General

7.1 The selection of nominations for appearance on the Website is entirely at the Promoter’s discretion.

7.2 By making a nomination for the Awards, you grant to the Promoter a perpetual, non-exclusive, royalty free, non-transferable, irrevocable licence for the full period of copyright to use and reproduce any content provided by you to the Promoter or any third party acting on the Promoter’s behalf (including any content submitted as part of the nominations or otherwise, both before and after the Awards’ entry period) in connection with the Awards including without limitation in print and on the Website.

7.3 You agree that the Promoter may use your name, and the name of your nomination, and/or likeness for advertising and/or publicity purposes in connection with the Awards including but not limited to publication of your name, and the name of your nomination, on the Website. Wherever practicable, you agree to obtain the consent of your nominee to the provisions of this paragraph 7.3.

7.4 The winners (and its representatives and personnel) may be required to and agree to take part in reasonable publicity events in connection with the Awards.

7.5 The Promoter is not responsible, and shall not be liable, for any problems related to any computer online systems or equipment, software failure of any email or failure of an entry to be received on account of technical problems or traffic congestion on the internet or the Website, or any combination thereof, including but not limited to any injury or damage to an entrant’s or any other person’s computer related to or resulting from participation in these Awards. Proof that an email has been sent will not be deemed proof of receipt. No nominations will be accepted in bulk, from agents or third parties.

7.6 In the event of any breach of these Terms and Conditions or any dispute regarding a nomination, the Promoter reserves the right in its absolute discretion to:

remove such nomination from display; and

exclude the relevant nomination and/or nominee from the Awards.

The Promoter reserves the right in its absolute discretion to disqualify any nomination which does not comply with these Terms and Conditions and/or any person making a nomination whose conduct is contrary to the spirit of these Terms and Conditions. In the event of circumstances beyond its reasonable control, the Promoter reserves the right to withdraw, amend or cancel the Awards and you agree that no liability shall attach to the Promoter as a result thereof.

These terms and conditions shall be governed by the laws of England and Wales and any dispute (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the English courts.
